上海市特种行业和公共场所治安管理条例
Regulations of Shanghai Municipality on the Administration of Peace and Order in Special Trades and Public Places 

（１９９７年１２月１１日上海市第十届人民代表大会常务委员会第四十次会议通过１９９７年１２月１８日公布１９９８年１月１日起施行）

第一章总则
Chapter I General Provisions 

第一条为了加强特种行业和公共场所治安管理，维护社会治安秩序，保障公民、法人和其他组织的合法权益，根据《中华人民共和国人民警察法》、《中华人民共和国治安管理处罚条例》和其他有关法律法规的规定，结合本市实际情况，制定本条例。
Article 1 The present Regulations are formulated, in accordance with the Police Law of the People’s Republic of China and the Punishment Regulations of the Administration of Peace and Order in the People’s Republic of China and the stipulations of other relevant laws and regulations, and in line with the actual situations in Shanghai, to strengthen the administration of peace and order in special trades and public places, to maintain peace and order in above-mentioned trades and places, to guarantee the legal rights of citizens, legal persons, and other organizations.

第二条本条例适用于本市行政区域内的旅馆、印章刻制、印刷、旧货、音像制品复制等特种行业和下列公共场所：
Article 2 The present regulations are applicable to the special trades such as hotels, seal engraving, printings, second-hand goods business, copying business of audio-visual products and the following public places within the administrative scope of Shanghai: 

（一）营业性娱乐场所；
1. Public places for entertainment business;

（二）设置按摩项目的服务场所；
2. The service places providing massage services;

（三）经营酒类的餐饮场所、咖啡馆、茶座；
3. Bars or saloons, cafes and teahouses;

（四）体育场（馆）、游泳池（场）、溜冰场、营业性射击场；
4. Stadiums(gymnasiums), swimming pools(spots), skating rinks and shooting ranges for business; and 

（五）大型公众性临时活动场所。
5. Large temporary mass activity spots.

第三条上海市公安局是本市特种行业和公共场所治安管理工作的主管部门，负责实施本条例。
Article 3 Shanghai Public Security Bureau is the department in charge of the administration of peace and order in special trades and public places within Shanghai and responsible for implementing the present regulations. 

区、县公安部门和专业公安部门具体负责管辖范围的特种行业和公共场所治安管理工作。
The district and county public security bureaus and the professional public security bureaus are responsible for the administration of peace and order in special trades and public places within their administrative scopes.

第四条本市工商行政、劳动、文化、体育、旅游、广播电影电视、园林、商业、卫生和新闻出版等行政管理部门应当按照各自职责，配合公安部门做好特种行业和公共场所的治安管理工作。
Article 4 The administrative departments of industrial and commercial administration, labor, culture, sports, tourism, movies, broadcasting and television, gardens and parks, commerce, public health, journalism shall, according to their respective obligations, assist the public security bureaus in the administration of peace and order in special trades and public places.

第二章许可管理
 Chapter II License Management 

第五条开办特种行业或者公共场所的单位（含个体工商户，下同），应当取得公安部门颁发的《上海市特种行业许可证》（以下简称《特种行业许可证》）或者《上海市公共场所治安许可证》（以下简称《公共场所许可证》），以及其他有关行政管理部门颁发的许可证和营业执照。
Article 5 Those (including self-employed industrial and commercial entrepreneurs) who are going to start a special trade or use a public place shall obtain the "License for Special Trades in Shanghai"(hereinafter referred to as "Special Trade License")or the"License for Peace and Order of Public Places in Shanghai"(hereinafter referred to as "Public Place License") or issued by public security bureaus, and shall obtain permits and business licenses issued by other administrative departments concerned.

未取得《特种行业许可证》或者《公共场所许可证》的单位，不得开办特种行业或者公共场所。
It is prohibited to start a special trade or use a public place without a Public Place License or Special Trade License.

第六条申领《特种行业许可证》的单位，应当具备下列条件：
Article 6 Those who apply for "Special Trade License" shall possess the following qualifications: 

（一）营业场地的布局和设施符合治安管理要求；
1. The layout and the facilities of the business spots shall meet the requirements of the administration of public security;

（二）符合该行业行政主管部门或者行业协会的资质条件；
2. They shall be approved correspondingly by the trade administration department or the trade association;

（三）有治安管理制度及相应的管理措施；
3. There shall be a system of administration rules of public security and corresponding measures for administration;

（四）有符合条件的法定代表人和经营负责人；
4. There shall be a qualified legal representative or responsible person for business operations; and 

（五）法律、法规规定的其他条件。
5. The other conditions stipulated by the law or regulations.

第七条申领《公共场所许可证》的单位，应当具备下列条件：
Article 7 Those who apply for "Public Place License" shall possess the following qualifications: 

（一）建筑物及各项设施符合治安防范要求；
1. The buildings and the facilities shall meet the requirements of public security;

（二）有与经营项目、活动人员容量相适应的场地；
2. There shall be suitable space for the business items and the people engaged;

（三）营业场地的布局和设施符合治安管理要求；
3. The layout and the facilities of the business spots shall meet the requirements of the administration of public security;

（四）有治安管理制度及相应的管理措施；
4. There shall be a system of the administration of public security and the corresponding measures; and 

（五）有符合条件的法定代表人和经营负责人。
5. There shall be a qualified legal representative or responsible person for business operations.

第八条有下列情形之一的人员，不得担任特种行业和公共场所单位的法定代表人和经营负责人：
Article 8 Anyone who commit one of the following offenses is prohibited to hold the position of the legal representative or responsible person for business operations: 

（一）被吊销《特种行业许可证》的特种行业单位的法定代表人和经营负责人，自被吊销《特种行业许可证》之日起未满三年的；
1. The legal representative or responsible person for business operations in special trades of which the "Special Trades License" was revoked within last three years;

（二）被吊销《公共场所许可证》的公共场所单位的法定代表人和经营负责人，自被吊销《公共场所许可证》之日起未满二年的；
2.The legal representative or responsible per for business operations in public places of which the "Public Place License" was rewoked within last two years;

（三）因犯有危害国家安全罪、危害公共安全罪、破坏社会主义市场经济秩序罪、侵犯财产罪、妨害社会管理秩序罪、贪污贿赂罪，被判处刑罚，执行期满未逾五年的；
3. Those who are punished for a crime of jeopardizing the safety of the State, or an offense against public security, or a crime of disrupting socialist market and economic order, or a crime against property, or a crime against social administrative order, or a crime of committing bribery and whose term of imprisonment does not go beyond five years; or 

（四）国家机关的在职工作人员。
4.In-service personnel of state organizations at different levels.

第九条申请《特种行业许可证》或者《公共场所许可证》的单位，应当向所在地的区、县公安部门提出书面申请。
Article 9 Those who apply for the "Public Place License" or the "Special Trade License" shall submit the written application to the relevant district or county public security bureaus. 

区县公安部门应当自接到申请书之日起三十日内审核完毕，对符合条件的，应当发给《特种行业许可证》或者《公共场所许可证》；对不符合条件的，应当在上述期限内书面告知申请单位。
The public security bureaus shall finish the checking within 30 days upon receiving the application and issue the "Special Trade License" or the "Public Place License"to those who are qualified, or send a written notification to those who are not qualified .

举办大型公众性临时活动的单位，应当在举办活动预定日的十五日前，向所在地的公安部门提出书面申请。
Those who hold large temporary activities shall submit the written application to the relevant public security bureaus 15 days prior to the activity. 

公安部门应当自接到申请书之日起五日内审核完毕，对符合条件的，应当发给《公共场所许可证》；对不符合条件的，应当在上述期限内书面告知申请单位。
The public security bureaus shall finish the checking within 5 days upon receiving the application and issue "Public Place License" to those who are qualified, or send a written notification to those who are not qualified.

禁止租借、转让、复制、涂改或者伪造《特种行业许可证》、《公共场所许可证》。
It is prohibited to lease, transfer, duplicate, alter, and forge the "Special Trade License" or the "Public Places License" .

第十条开办特种行业和公共场所的单位变更经营方式、经营范围、单位名称、单位地址、核定的布局设施、法定代表人或者经营负责人的，应当自变更之日起十五日内向原发证的公安部门备案。
Article 10 When the mode of the management, the scope of the business, the name of the business, the address of the business, the approved layout of the building, the legal representative or responsible persons for business operations are changed, those who start a special trade or use a public place shall register with the public security bureau who issued the original license for future reference within 15 days since the date of change.

第十一条持有《特种行业许可证》或者《公共场所许可证》的单位，应当接受原发证公安部门的年度审核。
Article 11 Those who bear the "Special Trade License" or the "Public Place License" are subject to the annual examination by the public security bureau who issued the original license.

第三章从业管理
 Chapter III Employee Management 

第十二条特种行业和公共场所单位聘用的从业人员应当持有合法的身份证明或者务工证明，境外人员还应当符合国家和本市规定的其他条件。
Article 12 Employees working in the special trades or the public places shall possess the legal identity or legal working certificate. Personnel from abroad should also conform to the other conditions stipulated by the State and the Municipality.

第十三条特种行业和公共场所单位聘用的专职安全保卫人员应当具备下列条件：
Article 13 Professional security personnel in public places or special trades should possess, the following conditions: 

（一）具有本市常住户口；
1. Registered permanent residence in Shanghai;

（二）具有中等以上学历；
2. The middle or above educational background; and 

（三）未受过刑事处罚，但过失犯罪的除外。
3. Never being subject to any criminal punishment, except some petty offenses.

特种行业和公共场所单位的专职安全保卫人员、登记员、贵重物品保管员等特殊岗位的从业人员以及按摩和客房服务部门的负责人，应当接受有关法律、法规和治安业务的培训，并经公安部门考核合格，持证上岗。
Professional security personnel, registration assistants, valuable objects storekeepers and managers in charge of massage and room services shall be trained with the relevant laws, regulations and public security practices and shall not go to work before passing the examination of public bureau and possessing the corresponding license.

第十四条经营旅馆业的，应当执行住宿登记、访客管理、贵重物品保管和值班巡查等制度，并遵守下列规定：
Article 14 Those who run hotels shall form a system of check-in, visitor management, storing of valuable objects, guarding and making their rounds. In addition, the following stipulations shall be observed: 

（一）旅馆内不得存放危险物品、违禁物品；
1. Hotels shall not store dangerous and prohibited goods;

（二）旅馆内不得从事色情、卖淫嫖娼、赌博、吸毒、贩毒以及其他违法犯罪活动；
2. Hotels shall not be engaged in such illegal activities as eroticism, prostitution, gambling, drug abuse, drug trade, and so on; and 

（三）建立或者配备与其经营规模相适应的安全保卫部门或者安全保卫人员。
3. Setting up a security department or providing safeguards corresponding to the scale of its business.

第十五条经营印章刻制业的，承接印章刻制时，应当查验有效证件并予以登记，不得超出许可范围承接印章刻制业务；
Article 15 Those who run a seal engraving business shall examine the valid certificates and have them registered when they undertake a seal engraving task. It is prohibited to carry on seal engraving business outside the ratified scope. 

对刻制公章的，应当查验由公安部门出具的准刻证明，并按照规定的规格、字样、文字和数量刻制。
As far as the official seals are concerned, they shall be approved by the public security bureau and keep in line with the ratified size, style language, and number of the official seal.

生产、经营特种印章制作设备的，应当向公安部门备案。
Those who produce and deal in the equipment of special seal engraving shall register themselves with the public security bureau. 

销售特种印章制作设备的，应当将销售情况登记备查。
In particular, those who trade in the equipment of special seal engraving shall register their sales for future reference.

购买特种印章制作设备的，应当事先经公安部门批准。
Those who want to buy the equipment of special seal engraving shall first obtain the approval of the public security bureau.

第十六条经营印刷业的，应当遵守下列规定：
Article 16 Those who are engaged in printing businesses shall observe the following stipulations: 

（一）执行承印验证登记、监印监销、保管、保密和发货等制度；
1. Carrying out the systems of probation and registration, supervision of print and sale, storage, confidentiality, and dispatch;

（二）不得承接有危害国家安全、封建迷信、色情或者淫秽内容以及国家和本市禁止的其他印刷业务；
2. It is prohibited to print anything that endangers the security of the State and contains feudal superstition, eroticism or pornography, and other things that is forbidden by the Municipality and the State;

（三）不得超出许可范围承接印刷业务；
3.It is prohibited to print anything that is beyond the scope of permission; and 

（四）承接特种印件印刷业务时，须查验由公安部门和其他有关部门出具的准印证明。
4. While taking up the business of printing special materials, they shall examine the permit issued by the public security bureau and other department concerned.

销售、购买多色复印设备的，应当事先经公安部门批准并按照规定使用。
Those who sell and buy multi-color copying machines shall obtain the ratification of the public security bureau and put them into proper use.

第十七条经营旧货业的，应当遵守下列规定：
Article 17 Those who trade in second-hand commodity shall observe the following stipulations: 

（一）执行收购、寄售、典当和拍卖验证登记制度；
1. The registration systems of purchase, consignment, pawn and auction verification shall be carried out;

（二）不得收购、寄售、承典、承当或者拍卖国家和本市禁止经营的物品；
2. It is prohibited to purchase, consign, pawn and auction the goods beyond the sanctioned scope by the State and the Municipality;

（三）不得超出许可范围收购废旧物品；
3. It is prohibited to purchase the waste and old goods that are beyond the scope of permission; and 

（四）不得在铁路沿线、机场、码头、军事禁区以及冶炼加工企业附近，设点收购废旧金属物品。
4. It is prohibited to purchase the second-hand goods along the railway, near the airport, seaport, military zone and smelting areas.

第十八条经营音像制品复制业的，在承接音像制品复制业务时，应当查验有关行政管理部门出具的批准文件；
Article 18 Those who are engaged in the duplication of audio-visual products shall check the approvals issued by the relevant administrative departments and not undertake the duplication of audio-visual products without approvals; 

不得承接无批准文件的音像制品复制业务，不得承接有危害国家安全、封建迷信、色情或者淫秽内容以及国家和本市禁止的其他复制业务。
they shall not be engaged in the duplication business that contains the content that threatens the security of the State or the content of salacity, pornography, feudal superstition. It is also prohibited to deal in the duplication business that is forbidden by the State and the Municipality.

购买音像制品复制生产设备的，应当向公安部门备案。
Those who want to purchase the equipment of duplication production lines shall register with the public security bureau.

第十九条经营公共场所的，应当遵守下列规定：
Article 19 Those who run the public places shall observe the following stipulations: 

（一）场所内活动的人员不得超过核定的人数；
1. People who participate the activity shall not go beyond the sanctioned number;

（二）发现治安隐患及时整改；
2. Punctual corrections shall be made when the hidden dangers of peace and order are found;

（三）场所内不得从事色情、卖淫嫖娼、赌博、吸毒、贩毒以及其他违法犯罪活动；
3. Activities like salacity, pornography, prostitution, gambling, drug abuse , drug trade and other criminal behaviors are prohibited within the public place;

（四）场所内不得从事封建迷信活动；
4. Feudal superstitious activities are prohibited within the public place; and 

（五）不得影响周围单位和居民的正常工作、生活。
5. The normal work and life of the nearby units and residents shall not be interrupted by these activities.

第二十条特种行业和公共场所单位及其从业人员应当遵守本条例以及其他有关治安管理的规定。
Article 20 Units of the special trades and public places as well as the personnel engaged in these businesses shall abide by the present regulations and other relevant regulations of the administration of public security.

特种行业的顾客、进入公共场所活动的人员，应当遵守法律、法规的有关规定，尊重社会公德，维护社会治安秩序。
Customers of the special trades and people who participate in the activities in the public places shall abide by the relevant stipulations of the law and regulations, respect social morality and maintain peace and order of the society.

第二十一条特种行业和公共场所单位发现场所内有违法犯罪活动或者违法犯罪嫌疑人、可疑物品，应当立即向公安部门报告。
Article 21 Any criminal activities, suspects, or suspicious objects found within the special trades or the public places shall be reported immediately to the public security bureau.

第二十二条特种行业和公共场所单位的法定代表人或者负责人是本单位的治安责任人，负责本单位的治安防范工作，并履行下列职责：
Article 22 The legal representative or the responsible person of special trades or public places is the person in charge of the public security of the unit in itself, and takes the responsibility of maintaining peace and order as well as performs the following duties: 

（一）审定并落实各项治安防范制度；
1. Examine the peace and order regulations and put them into effect;

（二）检查治安防范工作，提出奖惩建议；
2. Inspect the peace and order work and make suggestions of praise and punishment;

（三）如实向公安部门反映本单位的治安状况，配合公安部门对本单位进行治安检查；
3. Exactly report to the public security bureau the conditions of peace and order, and help the public security bureau make inspection of this unit for peace and order;

（四）及时制止违法犯罪活动，并向公安部门报告；
4. Restrain immediately the criminal activities happening in the unit and report them to the public security bureau; and 

（五）发现治安隐患，落实整改措施。
5. Implement rectification measures once the hidden dangers of peace and order are found.

前款规定的治安责任人的职责，不得因承包经营等原因转移给他人。
The responsibility of the person in charge of public security stipulated in the previous Article must not be transferred to other people by contract. 

特种行业和公共场所单位的承包经营人在承包期间，也应当按照前款规定承担治安防范责任。
Those who manage special trades or public places by contract shall also undertake the peace and order protection responsibilities stipulated in the previous Article during the period of the contract.

第二十三条公安人员对特种行业或者公共场所单位进行治安检查时，应当持有人民警察证件并出示由市公安局统一制发的治安检查证件。
Article 23 Personnel of public security bureau shall bear the police certificates and produce the peace and order inspection certificate printed and issued uniformly by the Municipal Public Security Bureau. 

被检查的单位和个人，不得妨碍、拒绝检查。
The units or individuals inspected shall not interfere with or refuse the inspection. 

公安人员违反上述规定的，被检查单位有权拒绝检查。
If the inspecting personnel of public security bureau violates the above-mentioned stipulations, the units inspected have the right to refuse the inspection.

公安人员对特种行业或者公共场所单位进行治安检查时，应当文明执法，公正执法；不得玩忽职守、滥用职权、徇私舞弊；
During the peace and order inspection of special trades and public places, personnel of public security bureau shall execute the law courteously and fairly, and they must not neglect their duties, or abuse their power, or play favouritism and commit irregularities. 

禁止对违反治安管理的人员打骂、虐待或者侮辱。
It is prohibited to scold and beat, to ill-treat or to insult the people who violate the peace and order regulations.

第四章法律责任
 Chapter IV Legal Liability 

第二十四条违反本条例的人员，应当给予治安处罚的，由公安部门依照《中华人民共和国治安管理处罚条例》的规定处罚。
Article 24 Offenders of the present regulations are to be punished according to the Regulations of the People’s Republic of China on Public Security Administration and Imposition of Punishment.

单位违反本条例规定，应当给予处罚的，法律、行政法规有规定的从其规定；
The units that violate the present regulations are to be punished according to the stipulations of the law and regulations; 

法律、行政法规没有规定的，由公安部门责令改正，并依照下列规定给予处罚：
if there is no corresponding stipulations in the law or regulations, the units are to be ordered to rectify and be punished by the public security bureau according to the following stipulations: 

（一）违反本条例第五条第二款规定，未取得《特种行业许可证》或者《公共场所许可证》，擅自开设特种行业或者公共场所的，予以取缔，处一千元以上一万元以下罚款；情节严重的，处一万元以上十万元以下罚款；
1. Those who violate Section2 of Article 5, and take the liberty to start a special trade or run a public place without obtaining the "Special Trade License" or the "Public Place License" are to be banned, and meanwhile, a fine between 1,000 and 10,000 yuan will be imposed. In serious cases, a fine between 10,000 and 100,000 yuan will be imposed;

（二）违反本条例第九条第三款、第十条、第十一条规定的，处警告、一千元以上一万元以下罚款；情节严重的，可以并处吊销《特种行业许可证》或者《公共场所许可证》；
2. Those who violate Section 3 of Article 9, Article 10, and Article 11 are to be warned, and a fine between 1,000 and 10,000 yuanwill be imposed. In serious cases, the "Special Trade License" or the "Public Place License" is to be revoked;

（三）违反本条例第十二条、第十三条规定的，责令限期清退，并按每聘用一人处五百元以上二千元以下罚款；
3. Those who violate Articles 12 and 13 are to be ordered to lay off the employees within a definite time, and to be fined 500 and 2,000 yuan for every employee in question;

（四）违反本条例第十四条、第十五条、第十六条、第十七条、第十八条、第十九条规定的，处警告、一千元以上一万元以下罚款；
4. Those who violate Articles 14, 15, 16, 17, 18 and 19 are to be warned and a fine between 1,000 and 10,000 yuan is to be imposed. 

情节严重的，处一万元以上十万元以下罚款，可以并处责令停业整顿、吊销《特种行业许可证》或者《公共场所许可证》；
In serious cases, the fine will be between 10,000 and 100,000 yuan, and the unit is ordered to stop operation, the "Special Trade License" or the "Public Places Lisence"is to be revoked; or 

（五）违反本条例第二十一条规定，未向公安部门报告的，处警告、一千元以上一万元以下罚款；
5. Those who violate Article 21, and do not report to the public security bureau are to be warned and a fine between 1,000 and 10,000 yuan will be imposed. 

情节严重的，责令停业整顿、吊销《特种行业许可证》或者《公共场所许可证》。
In serious cases, the unit is ordered to stop operation,the "Special Trade License" or the "Public Place License" is to be revoked.

违反本条例规定，有违法所得和非法财物的，由公安部门依法予以没收。
For the offenders of the present regulations, their illegal gains and possessions are to be confiscated by the public security bureau.

第二十五条被吊销《特种行业许可证》、《公共场所许可证》的单位，五年内不得重新申领《特种行业许可证》、《公共场所许可证》。
Article 25 Those whose " Special Trade License" or "Public Place License" has been revoked cannot apply for them again within five years.

第二十六条公安部门应当在作出吊销《特种行业许可证》或者《公共场所许可证》处罚决定之日起七日内，将处罚决定抄告有关行政管理部门。
Article 26 The public security bureau shall send to the relevant administrative departments a copy of the punishment decision within 7 days after they have made the decision to revoke the "Special Trade License" or the "Public Places License".

第二十七条公安人员违反本条例规定，玩忽职守、滥用职权、徇私舞弊的，由其所在单位或者上级主管部门给予行政处分。
Article 27 Public security officers will be given a disciplinary sanction by their departments or superior administrative departments if they violate the present regulations, neglect their duties, abuse their power or play favoritism and commit irregularities.

公安部门及其工作人员违法行使职权侵犯公民、法人和其他组织的合法权益造成损害的，应当依照法律、法规的规定予以赔偿。
When the public security departments and their crew encroach on the legal rights of a citizen, a legal representative or other institutions in performing their duty and cause losses, they must make corresponding compensation in line with the stipulations of the law and regulations.

第二十八条违反本条例规定，构成犯罪的，依法追究刑事责任。
Article 28 Those who violate the present regulations and whose behavior are considered to constitute a crime are subject to penal sanctions.

第五章附则
 Chapter V Supplementary Provisions 

第二十九条本条例所称的责令改正的期限，不得超过十五日；停业整顿的期限为十五日以上六个月以下。
Article 29 The time limit stipulated in the present Regulations for those who are ordered to make corrections shall not go beyond 15 days, while the time limit of those who are ordered to suspend business to bring up to standard is 15 days to 6 months.

第三十条本条例的具体应用问题由市公安局负责解释。
Article 30 The Municipal Public Security Bureau are responsible for the interpretation of the specific application of the present regulations.

第三十一条本条例自１９９８年１月１日起施行。
Article 31 The present Regulations shall become effective on January 1, 1998.
