上海市城乡集市贸易食品卫生管理规定（修正）
Provisions of Shanghai Municipality on the Control of Hygiene of the Food Sold on Urban and Rural Fairs

第一条 为了加强本市城乡集市贸易的食品卫生管理，保证食品卫生，保障人民身体健康，根据《中华人民共和国食品卫生法》和国务院发布的《城乡集市贸易管理办法》，结合本市具体情况，制定本规定。
Article 1 The present Provisions are formulated in accordance with the "Food Hygiene Law of the people's Republic of China" and the "Procedures on the Administration of Urban and Rural Fairs" promulgated by the State Council, and in the light of the actual situation in Shanghai with a view to strengthening the control of hygiene of the food sold on the urban and rural fairs in this municipality, ensuring food hygiene, and protecting the health of the people.
第二条 凡在本市城乡集市从事食品生产、经营的单位和个人，必须遵守本规定。
Article 2 All the units and individual persons who are engaged in food production and trading on the urban and rural fairs in this municipality shall abide by the Present Provisions.
第三条 工商行政管理部门负责集市的食品卫生管理工作，主要职责是：
Article 3 The industrial and commercial administrative departments are in charge of the food hygiene control on the fairs. Their main responsibilities are:
负责设立集市的登记；对集市举办者进行管理、监督；对集市场地和上市的食品进行日常卫生检查；组织集市食品卫生检查人员的食品卫生知识培训；查验集市食品生产经营者的有关营业证照；对违反本规定的行为依法进行处罚。
To register the establishment of fairs; exercise administration and supervision over fair organizers; conduct routine hygiene inspections on market places and the food marketed, organize training for the food hygiene inspectors of the fairs in food hygiene knowledge, check the business licenses of the food producers and traders on the fairs; and punish the acts of violating the present Provisions according to law.
卫生行政部门负责集市的食品卫生监督检验工作，主要职责是：
The public health administrative departments are in charge of the food hygiene supervision and inspection on the fairs. Their main responsibilities are
进行食品卫生监测、检验和技术指导；协助培训食品生产经营人员，监督食品生产经营人员的健康检查；宣传食品卫生、营养知识，进行食品卫生评价，公布食品卫生情况；对食物中毒和食品污染事故进行调查，并采取控制措施；对违反本规定的行为依法进行处罚。
to conduct food hygiene monitoring, inspection and technical guidance, assist in the training of food producers and traders, supervise the health check of the food producers and traders, publicize the knowledge of food hygiene and nutrition, carry out food hygiene evaluation, publish information about food hygiene, investigate the accidents of food poisoning and food contamination and take control measures, and punish the act of violating the present Provisions according to law.
乡镇人民政府和街道办事处应当协助工商行政管理部门和卫生行政部门实施本规定。
The township (town) people's governments and the sub-district offices shall assist the industrial and commercial administrative departments and the public health administrative departments in implementing the present Provisions.
畜、禽的检疫工作由兽医检疫机构负责。
The veterinary quarantine organs are in charge of the quarantine of livestock and poultry.
商业、水产、环卫、公安等有关部门应按各自分工，做好工作，切实实施本规定。
The departments in charge of commerce, aquatic products, environmental protection and public security shall conscientiously implement the present Provisions according to their respective assigned jobs.
第四条 集市应当根据食品分类，划行归市，分段设摊，合理布局，设置符合卫生标准的水源及其他公共卫生设施，保持环境整洁，防止交叉污染。
Article 4 The markets shall allocate different zones for different food varieties, rationalize their overall layout, install hygienic water supply and other public health facilities, maintain a clean and tidy environment, and prevent cross contamination.
集市举办者应当配备食品卫生检查人员，负责集市中有关证照的查验和上市食品的一般卫生检查以及食品生产经营者个人卫生的管理工作。
The market organizers shall assign food hygiene inspectors to take charge of checking the relevant licenses and permits on the fairs, carrying out general hygiene inspections on the food sold on the fairs and supervising the personal health of the food producers and traders.
第五条 在集市经营食品必须遵守以下规定：
Article 5 Those who sell food on the fairs shall abide by the following stipulations:
（一）出售的各类食品，必须清洁卫生，无毒无害，符合国家和本市有关食品卫生的规定；
1. All food items sold on the fairs must be clean, hygiene, nonpoisonous and unharmful, and conform to the provisions of the State and the Municipality on food hygiene;
（二）肉品、内脏、鳝丝等食品，必须经食品卫生检查人员查验，加盖查验合格章或者发给合格牌证后，方能出售；
2. Food items such as meat products, viscera and shredded finless eels and other food items can only be sold after being inspected by the food hygiene inspectors and stamped with an "inspection passed" seal or given an "inspection passed" certificate;
（三）在集市生产经营食品的店、摊，应当持有工商行政管理部门核发的有关营业证照，其中按照市卫生行政部门规定需要办理《食品卫生许可证》的，应当先向卫生行政部门申领《食品卫生许可证》；
3. The shops and stalls producing and selling food items on the fairs shall hold the business licenses issued by the industrial and commercial administrative departments, and those who are required by the municipal public health administrative department to hold a food hygiene license, shall first apply to the municipal public health administrative department for a food hygiene license;and
（四）在当年十一月至次年四月期间生产经营食用畜禽血的，必须持有兽医卫生检验合格证明，在五月至十月期间生产经营食用畜禽血的，还必须经市卫生行政部门许可。
4. Those who produce and sell edible blood products of livestock and poultry between November of the current year and April of the next year must have the certificates issued by the veterinary health inspection, and those who produce edible blood products of livestock and poultry between May and October must also obtain the permission from the municipal public health administrative department.
第六条 禁止在集市经营下列食品：
Article 6 Dealing in the following food items on the fairs is prohibited:
（一）腐败变质、油脂酸败、霉变、生虫、污秽不洁或者感官性状异常的食品；
1. The food items that are putrid, oily sour, mildewy, wormeaten, dirty or offensive to sense organs;
（二）河豚鱼、野蘑菇等有毒动植物以及被有毒有害物质污染的食品；
2. The poisonous animals and vegetables including balloonfish (globefish) and wild mushrooms and the food items that are contaminated by poisonous and harmful substance;
（三）未经检验或者检验不合格的肉类及其制品；
3. The meat and meat products that are not inspected or fail to pass inspections;
（四）病死、毒死或者死因不明的禽、畜（包括野味）肉及其制品；
4. The meat and meat products of the poultry and livestock (including games) that died of diseases, poisoning or unknown reasons;
（五）死的黄鳝、甲鱼、乌龟、河蟹、蟛蜞、螯虾及死的贝壳类水产品；
5. The dead aquatic products, such as finless eels, turtles, tortoise, river crabs, brackishwater crabs (amphibious crabs), chela shrimps and shellfish;
（六）毛蚶、泥蚶、魁蚶和一矾海蜇、二矾海蜇、咸烤虾以及未经市卫生行政部门许可生产的醉制或者腌制的蟛蜞、虾、蟹、泥螺等生食水产品；
6. Blood clams, mud clams, jumbo clams (kuihan), once vitriolled jellyfish, twice vitriolled jellyfish, dry salted shrimps, and the raweaten aquatic products that are produced without the permission of the municipal health administrative department including the liquorsaturated or preserve d brackish water crabs, shrimps, crabs and mud snails;
（七）腐烂、削皮的瓜果；
7. Rotten or peeled melons or fruit;
（八）使用污秽不洁或者被农药、化肥等有毒有害物污染的容器、包装材料盛装的食品；
8. The food items contained in the containers and packaging materials that are dirty or contaminated by pesticides, chemical fertilizers and other toxic and harmful substance;
（九）市卫生行政部门为预防疾病等特殊需要，专门规定禁止出售的食品；
9. The food items that are specially barred from selling by the municipal public health administrative department out of the particular necessity of preventing diseases; or
（十）其他不符合食品卫生标准和食品卫生规定的食品。
10. Other food items that do not meet the food hygiene standards and food hygiene stipulations.
第七条 因不符合新鲜销售卫生要求而不能直接销售的水产、肉类等食品，经食品卫生检查人员或者食品卫生监督员指导加工后，符合卫生要求的可以出售。
Article 7 The food items such as aquatic products, meat and other products which are not allowed to be directly sold because they do not meet the hygiene requirements for being sold fresh may be sold after they have been processed under the guidance of the food hygiene inspectors or food hygiene supervisors and have met the hygiene requirements.
第八条 违反本规定第五条、第六条的，由集市举办者制止其出售和转移，并及时报告工商行政管理部门或者卫生行政部门进行处理。
Article 8 The fair organizers must stop those who violate the provisions of Articles 5 and 6 of the present Provisions from selling and moving away the food items involved, and must report the cases without delay to the industrial and commercial administrative departments or the public health administrative departments for disposal.
第九条 违反本规定，造成食物中毒事故或者其他食源性疾患的，应当负损害赔偿责任。
Article 9 Those who have caused food poisoning or other food-borne diseases in violation of the stipulations of the present Provisions shall be held liable for damages.
受害人有权要求损害赔偿。
The victims have the right to claim damages.
第十条 有下列行为的，由卫生行政部门按照下列规定处罚：
Article 10 The public health administrative departments shall punish the following acts according to the following stipulations:
（一）未按照规定取得《食品卫生许可证》在集市中生产经营食品的，责令限期改正，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以五百元以上三万元以下的罚款；
1. Anyone who fails to obtain the Food Hygiene License for producing and selling food items on the fairs shall be ordered to correct his mistakes within the specified time limit, have his/her illegal earnings confiscated and pay a fine between one and five times his/her illegal earnings. If he/she has no illegal earnings, he/she shall be ordered to pay a fine of between 500 and 30,000 yuan;
（二）生产经营不符合卫生标准的食品，造成食物中毒事故或者其他食源性疾患的，责令停止生产经营并销毁该食品，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以一千元以上五万元以下的罚款；情节严重的，吊销《食品卫生许可证》。
or 2. Anyone who produces and sells food items that do not meet the hygiene standards and has caused food poisoning or other food-borne diseases shall be ordered to stop the production and selling of such food items and to destroy them, have his/her illegal earnings confiscated and pay a fine between one and five times his/her illegal earnings. If he/she has no illegal earnings, he/she shall be ordered to pay a fine of between 1,000 and 50,000 yuan. If the case is serious, his/her Food Hygiene License shall be revoked.
有下列行为的，由工商行政管理部门或者卫生行政部门按照下列规定处罚：
The industrial and commercial administrative departments or the public health administrative departments shall punish the following acts according to the following stipulations:
（一）违反本规定第五条第（一）项、第（二）项、第（四）项的，责令限期改正，给予警告，并处以五千元以下的罚款；
1. Anyone who has violated the provisions of Items 1, 2 and 4 of Article 5 of the present Provisions shall be ordered to correct his/her mistakes within the specified time limit, given a disciplinary warning and pay a fine of less than 5,000 yuan;
（二）生产经营禁止生产经营的食品的，责令停止生产经营并销毁该食品，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以一千元以上五万元以下的罚款；
2. Anyone who produces and sells the food items that are prohibited from production and selling shall be ordered to stop the production and selling of such food items and to destroy them, have his/her illegal earnings confiscated and pay a fine between one and five times his/her illegal earnings. If he/she has no illegal earnings, he/she shall be ordered to pay a fine of between 1,000 and 50,000 yuan; or
（三）集市内食品生产经营过程不符合国家和本市卫生要求的，责令责任者改正，并给予警告或者处以五千元以下的罚款。
3. Where the process of food production and selling on the fair do not meet the health requirements of the State and this Municipality the responsible party shall be ordered to correct the mistakes and face a warning or pay a fine of less than 5,000 yuan.
违反本规定行为给他人造成损害的，应当依法承担民事赔偿责任。
Anyone whose doing has violated the provisions of these provisions and has cause damage to other people shall be held liable for civil damages.
对造成严重食物中毒事故或者其他严重食源性疾患，致人死亡或者致人残疾丧失劳动能力的，应当依法追究责任人员的刑事责任。
For the accident of serious food poisoning or other serious food-borne diseases resulting in human deaths or disabilities the responsible person(s) shall be prosecuted for criminal liability according to law.
第十一条 工商行政管理部门和卫生行政部门作出行政处罚，应当出具行政处罚决定书。
Article 11 On imposing an administrative punishment, the industrial and commercial administrative departments and the public health administrative department shall issue a decision notice of an administrative punishment.
当场收缴罚没款的，应当出具市财政部门统一印制的罚没财物收据。罚没收入按照规定上缴国库。
For the collection of fines and confiscated money on the spot, unified receipts for fines and confiscated money/goods printed exclusively by the municipal finance department shall be issued.The fines and confiscated money collected shall be turned over to the State Treasury according to the provisions.
第十二条 在集市生产经营食品的单位或者个人，应当接受工商行政管理人员和食品卫生监督员的管理。
Article 12 The units or individual persons that produce and sell food items on the fairs shall accept the supervision of the industrial and commercial administrative personnel and the food hygiene supervisors.
当事人对工商行政管理部门或者卫生行政部门的具体行政行为不服的，可以按照《行政复议条例》和《中华人民共和国行政诉讼法》的规定，申请行政复议或者提起行政诉讼。
If the party concerned refuses to accept the specific administrative act of the industrial and commercial administrative department and the public health administrative department, it may apply for administrative reconsideration or bring an administrative action in accordance with the provisions of the "Regulations on Administrative Reconsideration" and the "Administrative Litigation Law of the people's Republic of China".
当事人在法定期限内不申请复议、不提起诉讼又不履行具体行政行为的，作出具体行政行为的工商行政管理部门和卫生行政部门可以依据《中华人民共和国行政诉讼法》的规定，申请人民法院强制执行。
If the party concerned neither applies for reconsideration or bring an action, nor perform the specific administrative act within the statutory period, the industrial and commercial administrative department or the public health administration department which has made the decision on the specific administrative act may apply to the people's court for enforcement in accordance with the provisions of the "Administrative Litigation Law of the people's Republic of China".
第十三条 工商行政管理人员和食品卫生监督员执行任务时，应当向当事人出示执法身分证件。
Article 13 The industrial and commercial administrative personnel and the food hygiene supervisors shall produce their law enforcement identification cards during the performance of official duties.
工商行政管理人员和食品卫生监督员应当遵纪守法，秉公办事。对玩忽职守、徇私舞弊、滥用职权的，由其所在单位或者上级主管部门给予行政处分；构成犯罪的，依法追究刑事责任。
The industrial and commercial administrative personnel and the food hygiene supervisors shall observe discipline, abide by laws and act with justice. Those who have neglected their duties, act wrongly for selfish ends and abuse their powers shall face administrative punishment imposed by their work units or the higher authorities. Those whose act constitutes a crime shall be prosecuted for their criminal liability.
第十四条 食品卫生监督员可以按照规定无偿采取适量的食品样品用于检验。采取食品样品时，应当开具收据。
Article 14 The food hygiene supervisors may take an appropriate amount of sample food items free of charge for inspection and testing according to law. A receipt shall be issued when a sample food item is taken.
第十五条 本市城乡农副产品交易点和在本市穿街走巷的食品商贩适用本规定。
Article 15 The present Provisions also apply to the urban and rural trading spots of farm and side-line products and the street vendors of food items in this municipality.
第十六条 本规定经上海市人民代表大会常务委员会批准，由上海市人民政府颁布，自1985年8月1日起施行。
Article 16 The present Provisions shall be promulgated by the Shanghai Municipal people's Government after being adopted by the Standing Committee of Shanghai Municipal people's Congress, and shall become effective on August 1, 1985.
