价格违法行为行政处罚规定

Rules of Administrative Sanctions on Price Offense

第一条为了依法惩处价格违法行为，保护消费者和经营者的合法权益，根据《中华人民共和国价格法》（以下简称价格法）的有关规定，制定本规定。

Article 1 In order to punish price offenses according to law and protect the lawful rights and interests of the consumers, these Regulations are hereby formulated in accordance with relevant regulations provided in Price Law of the People’s Republic of China (hereinafter referred to as the “price law”).

第二条县级以上各级人民政府价格主管部门依法对价格活动进行监督检查，并决定对价格违法行为的行政处罚。

Article 2 The administrations in charge of price control in the People’s Governments at a level than the county shall conduct supervisions over pricing according to law and decide the administrative sanctions on price offenses.

第三条价格违法行为的行政处罚由价格违法行为发生地的地方人民政府价格主管部门决定；

Article 3 The administrations in charge of price control in a Local People’s Government in the place where the price offenses occur shall decide the administrative sanctions on price offenses; 

国务院价格主管部门规定由其上级价格主管部门决定的，从其规定。

if the decision shall be made a competent agency in charge of price control at a higher level stipulated by the administration in charge of price control under the State Council, such regulation shall be followed.

第四条经营者违反价格法第十四条的规定，有下列行为之一的，责令改正，没收违法所得，可以并处违法所得５倍以下的罚款；

Article 4 If an operator has violated the provisions in Article 14 of the Price Law under any of the following circumstances, he/she shall be ordered to make corrections, the illegal gains shall be confiscated, and a fine not more than 5 times of the illegal gains may be imposed upon; 

没有违法所得的，给予警告，可以并处３万元以上３０万元以下的罚款；情节严重的，责令停业整顿，或者由工商行政管理机关吊销营业执照：

if no illegal gains are involved, a warning may be given, and a fine of no less than RMB30, 000 but not more RMB300, 000 may be simultaneously imposed; and if the circumstances are serious, the operator shall be ordered to suspend business for internal rectification, or the administration for industry and commerce shall revoke his/her business license. 

（一）相互串通，操纵市场价格，损害其他经营者或者消费者的合法权益的；

(1) To collude with each other, control the market price to the detriment of the lawful rights and interests of other operators or consumers; 

（二）除依法降价处理鲜活商品、季节性商品、积压商品等商品外，为了排挤竞争对手或者独占市场，以低于成本的价格倾销，扰乱正常的生产经营秩序，损害国家利益或者其他经营者的合法权益的；

(2) To dump goods except those which are fresh, seasonal, or in overstock and thereupon are marked down, at a price lower than their cost for the purpose of pushing out others or monopolizing the market and the such has disrupted the normal order of the production and operation to the detriment of the lawful rights and interests of the Sate or other operators; or 

（三）提供相同商品或者服务，对具有同等交易条件的其他经营者实行价格歧视的。

(3) To practice price discriminations against other operators who enjoy the same terms of exchange by offering an identical commodity or service.

第五条经营者违反价格法第十四条的规定，捏造、散布涨价信息，哄抬价格，推动商品价格过高上涨的，或者利用虚假的或者使人误解的价格手段，诱骗消费者或者其他经营者与其进行交易的，责令改正，没收违法所得，可以并处违法所得５倍以下的罚款；

Article 5 If the operator, in violation the provisions in Article 14 of Price Law, has falsified, spread information about rise in price, forced up prices, pushed the commodity prices to rise excessively, or used false or misleading price measures to cheat consumers or other operators into a deal with him/her, he/she shall be ordered to make corrections, his/her illegal income shall be confiscated, and a fine of no less than 5 times of the income may be imposed;

没有违法所得的，给予警告，可以并处２万元以上２０万元以下的罚款；情节严重的，责令停业整顿，或者由工商行政管理机关吊销营业执照。

 if no illegal income is involved, a warning shall be given instead, and a fine of no less than RMB20,000 but not more than RMB 200,000 may be imposed; and if the circumstances are serious, the operator shall be ordered to suspend business for internal rectification, or the administration for industry and commerce shall revoke his/her business license.

第六条经营者违反价格法第十四条的规定，采取抬高等级或者压低等级等手段销售、收购商品或者提供服务，变相提高或者压低价格的，责令改正，没收违法所得，可以并处违法所得５倍以下的罚款；

Article 6 If the operator in violation of the regulations provided in Article 14 of Price Law has taken measures such as driving up or down the grade etc. to sell, purchase commodities or offer services, and thus to drive up or down the price in disguised form, he/she shall be ordered to make corrections, his/her illegal income shall be confiscated, and a fine of no less than 5 times of the income may be imposed; 

没有违法所得的，给予警告，可以并处１万元以上１０万元以下的罚款；情节严重的，责令停业整顿，或者由工商行政管理机关吊销营业执照。

if no illegal income is involved, a warning shall be given instead, and a fine of no less than RMB10,000 but not more than RMB100,000 may be imposed; and if the circumstances are serious, the operator shall be ordered to suspend business for internal rectification, or the administration for industry and commerce shall revoke his/her business license.

第七条经营者不执行政府指导价、政府定价，有下列行为之一的，责令改正，没收违法所得，可以并处违法所得５倍以下的罚款；没有违法所得的，可以处２万元以上２０万元以下的罚款；情节严重的，责令停业整顿：

Article 7 If the operator fails to execute the guidance price of the government under the any of the following circumstances, he/she shall be ordered to make corrections, his/her illegal income shall be confiscated, and a fine of not more than 5 times of the illegal income may be otherwise imposed; if no illegal income is involved, a warning shall be given instead, and a fine of no less than RMB20,000 but not more than RMB200,000 may be imposed; and if the circumstances are serious, the operator shall be ordered to suspend business for internal rectification: 

（一）超出政府指导价浮动幅度制定价格的；

(1) To fix a price beyond the floating range of the guidance price of the government; 

（二）高于或者低于政府定价制定价格的；

(2) To fix a price higher or lower than the price stipulated by the government; 

（三）擅自制定属于政府指导价、政府定价范围内的商品或者服务价格的；

(3) To fix without authorization the price of commodities or services within the range of the guidance price of the government, or government-fixed price; 

（四）提前或者推迟执行政府指导价、政府定价的；

(4) To implement the guidance price of the government, or government-fixed price ahead of time or later than the time limit; 

（五）自立收费项目或者自定标准收费的；

(5) To set up by oneself items of charge, or charging standards; 

（六）采取分解收费项目、重复收费、扩大收费范围等方式变相提高收费标准的；

(6) To push up charging standards in a disguised form by dividing items of charge, duplicating charges, or extending the range of charge; 

（七）对政府明令取消的收费项目继续收费的；

(7) To continue charge items cancelled by the government through public proclamation; 

（八）违反规定以保证金、抵押金等形式变相收费的；

(8) To charge fees in violation of regulations under a disguise in the form of guaranty bond, mortgage etc;

（九）强制或者变相强制服务并收费的；

 (9) To force up or force up under a disguise services and hereby charge fees; 

（十）不按照规定提供服务而收取费用的；

(10) To charge fees without offering services as regulated; or 

（十一）不执行政府指导价、政府定价的其他行为。

(11) To conduct other acts not to execute the guidance price of the government, or government-fixed prices.

第八条经营者不执行法定的价格干预措施、紧急措施，有下列行为之一的，责令改正，没收违法所得，可以并处违法所得５倍以下的罚款；

Article 8 If the operator fails to implement legally prescribed measures on price-intervening as well as urgent measures, under any of the following circumstances, he/she shall be ordered to make corrections,

没有违法所得的，可以处４万元以上４０万元以下的罚款；情节严重的，责令停业整顿：

the illegal income shall be confiscated, and a fine of no less than the illegal income may also be imposed; if no illegal income is involved, the operator may be fined no less than RMB40, 000 but not more than RMB400, 000; and if the circumstances are serious, the operator shall be ordered to suspend business for internal rectifications: 

（一）不执行提价申报或者调价备案制度的；

(1) Failing to implement the system under which the price in rise shall be declared and the change of price shall be put on record; 

（二）超过规定的差价率、利润率幅度的；

(2) Exceeding the range of price differences rate and profit rate; 

（三）不执行规定的限价、最低保护价的；

(3) Failing to implement the prescribe fixed price or minimum protective price; 

（四）不执行集中定价权限措施的；

(4) Failing to implement the joint measures on price-fixing limit of authority; 

（五）不执行冻结价格措施的；

(5) Failing to implement the measures on freezing prices; or 

（六）不执行法定的价格干预措施、紧急措施的其他行为。

(6) Failing to conduct other acts of implementing legally prescribed price-intervening measures or urgent measures.

第九条本规定第四条至第八条规定中经营者为个人的，对其没有违法所得的价格违法行为，可以处５万元以下的罚款。

Article 9 If the operator provided in Articles 4-8 is an individual, and he/she has committed price offenses but has no illegal income, he/she may be fined not more than RMB50, 000.

第十条经营者违反法律、法规的规定牟取暴利的，责令改正，没收违法所得，可以并处违法所得５倍以下的罚款；情节严重的，责令停业整顿，或者由工商行政管理机关吊销营业执照。

Article 10 If the operator has reaped staggering profits in violation of regulations provided by laws and regulations, he/she shall be ordered to make corrections, his/her illegal income shall be confiscated, and a fine of no less than 5 times of the income may be imposed; and if the circumstances are serious, the operator shall be ordered to suspend business for internal rectification, or the administration for industry and commerce shall revoke his/her business license.

第十一条经营者违反明码标价规定，有下列行为之一的，责令改正，没收违法所得，可以并处５０００元以下的罚款：

Article 11 If the operator has violated the regulations on selling at expressly marked prices under the any of the following circumstances, he/she shall be ordered to make corrections, his/her illegal income shall be confiscated, and a fine of not more than RMB5, 000 may be imposed:

（一）不标明价格的；

(1) Failing to mark prices;

（二）不按照规定的内容和方式明码标价的；

(2) Failing to mark prices in accordance with prescribed contents and ways; 

（三）在标价之外加价出售商品或者收取未标明的费用的；

(3) Selling commodities at a price higher than the marked price or charging fees which have not been marked; or 

（四）违反明码标价规定的其他行为。

(4) Conducting other acts in violation of the regulations of marking prices expressly.

第十二条拒绝提供价格监督检查所需资料或者提供虚假资料的，责令改正，给予警告；逾期不改正的，可以处５万元以下的罚款，对直接负责的主管人员和其他直接责任人员给予纪律处分。

Article 12 If the operator refuses to produce materials needed for supervision over price control or produces false materials, he/she shall be ordered to make corrections, and shall be given a warning; and if he/she fails to do so beyond the time limit, no less than RMB50, 000 shall be fined. In addition, the administrators and other persons held directly responsible shall be given disciplinary sanctions.

第十三条政府价格主管部门进行价格监督检查时，发现经营者的违法行为同时具有下列三种情形的，可以依照价格法第三十四条第（三）项的规定责令其暂停相关营业：

Article 13 If the competent governmental agency for price, while conducting supervision and inspection over price, has found the offenses of the operator under all three of the following circumstances, it may order the operator to suspend relevant operations in accordance with the regulations provided in Item (3) of Article 34 of Law of Price: 

（一）违法行为情节复杂或者情节严重，经查明后可能给予较重处罚的；

(1) Where the circumstances of the offence are complex or serious, and may be given relatively severe penalties after it is ascertained through investigation; 

（二）不暂停相关营业，违法行为将继续的；

(2) Where relevant operations are not suspended, the offence could continue; or 

（三）不暂停相关营业，可能影响违法事实的认定，采取其他措施又不足以保证查明的。

(3) Where relevant operations are not suspended, the verification of the offence might be affected, but other measures are not sufficient to ensure the verification. 

政府价格主管部门进行价格监督检查时，执法人员不得少于两人，并应当向经营者或者有关人员出示证件。

If the competent governmental agency is to conduct supervision and inspection over price, at least two law enforcement officers shall be needed and the officers shall produce their certificates to the operator or other personnel concerned.

第十四条经营者因价格违法行为致使消费者或者其他经营者多付价款的，责令限期退还；

Article 14 If the operator has caused the consumer or other operators to pay more money as a result of his/her price offence, he/she shall be ordered to return the money within a time limit; 

难于查找多付价款的消费者、经营者的，责令公告查找；

if it is difficult to find the consumers or operators who have paid more money than necessary, the operator shall be ordered to make announcement for finding them; 

公告期限届满仍无法退还的价款，以违法所得论处。

and if the money paid for purchase fails to be returned after the announcement period expires, the money shall be considered illegal gains.

第十五条经营者有行政处罚法第二十七条所列情形的，应当依法从轻或者减轻处罚。

Article 15 If the operator shall be imposed upon with a light punishment or a mitigated punishment according to law under the circumstances provided in Article 27 of Law on Disciplinary Sanctions 

经营者有下列情形之一的，应当从重处罚：

If the operator is under any of the following circumstances, he/she shall be punished seriously: 

（一）价格违法行为严重或者社会影响较大的；

(1) The price offence is serious and has great social effects; 

（二）屡查屡犯的；

(2) Committing offences repeatedly one after another; 

（三）伪造、涂改或者转移、销毁证据的；

(3) Falsify, alter, transfer, destroy evidences;

（四）转移与价格违法行为有关的资金或者商品的；

(4) Transfer the capital or commodities in collection with the price offence; or 

（五）应予从重处罚的其他价格违法行为。

(5) Other price offences which shall be given a severe punishment.

第十六条经营者对政府价格主管部门作出的处罚决定不服的，应当先依法申请行政复议；对行政复议决定不服的，可以依法向人民法院提起诉讼。

Article 16 If the operator does not accept the decision on penalties made by the governmental authority for price, he/she shall in the first place apply for administrative review; and if the operator still disagree with the decision of the administrative review, he/she may file a lawsuit according to law with a People’s Court.

第十七条逾期不缴纳罚款的，每日按罚款数额的３％加处罚款；逾期不缴纳违法所得的，每日按违法所得数额的２‰加处罚款。

Article 17 If the fine has not been paid beyond the time limit, 3% of the fine shall be added each day; if illegal gains fail to be handed over, 0.2% of the amount shall be added to the fine.

第十八条任何单位和个人有本规定所列价格违法行为，情节严重，拒不改正的，政府价格主管部门除依照本规定给予处罚外，可以在其营业场地公告其价格违法行为，直至改正。

Article 18 If any unit or individual has committed price offences as listed in these Measures, and if the circumstances are serious and the operator refuses to repent, the governmental agency for price shall impose upon him/her penalties as provide in these Measures, may announce his/her price offence in the place of business until he/she has made corrections.

第十九条价格执法人员泄露国家秘密、经营者的商业秘密或者滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。

Article 19 If the law enforcement officers of price divulges the State’s secrets, the business’s commercial secrets, abuse their power of office, neglect their duties, practice fraud for personal gains, and if the offence constitutes a crime, the offender shall be investigated for his/her criminal liability; if the offence does not constitute a crime, the offender shall be subject to disciplinary sanctions.

第二十条本规定自发布之日起施行。

Article 20 These Measures shall take effect as of the date of issuance.
