第一章总则

Chapter 1 General Principles 

第一条为了规范国务院行政机构的设置，加强编制管理，提高行政效率，根据宪法和国务院组织法，制定本条例。

Article 1 With a view to standardizing establishment of the administrative agencies of the State Council, promoting administration of the establishment and staffing thereof and improving administrative efficiency., these Regulations are hereby formulated according to the Constitution and the Organic Law of the State Council  

第二条国务院行政机构设置和编制管理应当适应国家政治、经济、社会发展的需要，遵循精简、统一、高效的原则。

Article 2 Administration of the establishment and staffing of the administrative agencies of the State Council shall adapt to the needs of political, economic, and social development of the State, and conform to the principles of simplification, unification and high efficiency.

第三条国务院根据宪法和国务院组织法的规定，行使国务院行政机构设置和编制管理职权。

Article 3 The State Council shall, according to the provisions stipulated in the Constitution and the Organic Law of the State Council, exercise the functions and powers of administration over establishment and staffing of the administrative agencies of the State Council. 

国务院机构编制管理机关在国务院领导下，负责国务院行政机构设置和编制管理的具体工作。

The agency and staffing administration organ of the State Council shall, under the leadership of the State Council, take the responsibility for the specific administration of establishment and staffing of the administrative agencies of the State Council.

第二章机构设置管理

Chapter 2 Administration of Agency Establishment 

第四条国务院行政机构的设置以职能的科学配置为基础，做到职能明确、分工合理、机构精简，有利于提高行政效能。

Article 4 The establishment of the administrative agencies of the State Council shall be based on the scientific al[] of functions and achieve a clarification of functions, rational division of duties and simplified structure to facilitate improvement of administrative efficiency. 

国务院根据国民经济和社会发展的需要，适应社会主义市场经济体制的要求，适时调整国务院行政机构；

The State Council shall, pursuant to the needs of the national economy and social development and based on the needs of the socialist market economy, adjusts in good time the administrative agencies of the State Council;

但是，在一届政府任期内，国务院组成部门应当保持相对稳定。

but the constituent ministries and commissions of the State Council shall be maintained relatively stable during the term of office of the Government.

第五条国务院行政机构的设立、撤销或者合并，由国务院机构编制管理机关事先组织有关部门和专家进行评估和论证。

Article 5 The agency and staffing administration organ of the State Council shall organize the relevant departments and experts in advance to appraise and validate the establishment, dissolution or merger of administrative agencies of the State Council is appraised and validated.

第六条国务院行政机构根据职能分为国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构、国务院组成部门管理的国家行政机构和国务院议事协调机构。

Article 6 The administrative agencies of the State Council are, pursuant to their functions, divided into the General Office of the State Council, the constituent ministries and commissions of the State Council, the agencies affiliated with the State Council, administrative offices of the State Council, the State agencies administrated by the constituent ministries or commissions of the State Council and the deliberation and coordination agencies of the State Council. 

国务院办公厅协助国务院领导处理国务院日常工作。

The leaders of the State Council shall enjoy the assist of the General Office of the State Council in handling the daily work of the State Council. 

国务院组成部门依法分别履行国务院基本的行政管理职能。国务院组成部门包括各部、各委员会、中国人民银行和审计署。

The basic administrative functions of the State Council shall, pursuant to law, be exercised the by the constituent ministries and commissions of the State Council, which include the various ministries or commissions, the People’s Bank of China and the Auditing Agency. 

国务院直属机构主管国务院的某项专门业务，具有独立的行政管理职能。

Certain specialized work of the State Council shall be under the charge of the agencies affiliated with the State Council, which have independent administrative functions. 

国务院办事机构协助国务院总理办理专门事项，不具有独立的行政管理职能。

The Premier of the State Council shall enjoy the assist of the administrative offices of the State Council in handling specialized affairs, which do not have independent administrative functions. 

国务院组成部门管理的国家行政机构由国务院组成部门管理，主管特定业务，行使行政管理职能。

The constituent ministries or commissions of the State Council shall administrate the State agencies administrated by the constituent ministries or commissions of the State Council, which shall take charge of specialized work and exercise administrative and managerial functions. 

国务院议事协调机构承担跨国务院行政机构的重要业务工作的组织协调任务。

The organization and coordination of the important work across administrative agencies of the State Council shall be undertaken by the deliberation and coordination agencies of the State Council. 

国务院议事协调机构议定的事项，经国务院同意，由有关的行政机构按照各自的职责负责办理。

The relevant agencies shall, pursuant to their respective duties and upon the consent of the State Council, handle the affairs deliberated and decided upon by the deliberation and coordination agencies of the State Council be handled by the. 

在特殊或者紧急的情况下，经国务院同意，国务院议事协调机构可以规定临时性的行政管理措施。

Upon the consent of the State Council, the deliberation and coordination agencies of the State Council shall stipulate interim administrative measures under special or urgent circumstances.

第七条依照国务院组织法的规定，国务院设立办公厅。

Article 7 A general office shall, according to the provisions of the Organic Law of the State Council, be established in the State Council. 

国务院组成部门的设立、撤销或者合并由国务院机构编制管理机关提出方案，经国务院常务会议讨论通过后，由国务院总理提请全国人民代表大会决定；

The agency and staffing administration organ of the State Council shall bring forward the proposal of the programmer for the establishment, dissolution or merger of constituent ministries and commissions of the State Council, which shall, upon the discussion and adoption by the Executive Meeting of the State Council, be submitted by the Premier of the State Council to the National People’s Congress for a decision. 

在全国人民代表大会闭会期间，提请全国人民代表大会常务委员会决定。

The program shall be submitted to its Standing Committee for a decision when the National People’s Congress is not in session.

第八条国务院直属机构、国务院办事机构和国务院组成部门管理的国家行政机构的设立、撤销或者合并由国务院机构编制管理机关提出方案，报国务院决定。

Article 8 The agency and staffing administration organ of the State Council shall bring forward the proposal of the program for the establishment, dissolution or merger of directly subordinate agencies of the State Council, administrative offices of the State Council, and the State agencies administrated by the constituent ministries or commissions of the State Council,, which shall be submitted to the State Council for a decision.

第九条设立国务院组成部门、国务院直属机构、国务院办事机构和国务院组成部门管理的国家行政机构的方案，应当包括下列事项：

Article 9 The following items shall be included in the programmer for the establishment of the constituent ministries and commissions of the State Council, the agencies affiliated with the State Council, the administrative offices of the State Council, the State agencies administered by the constituent ministries or commissions of the State Council: 

（一）设立机构的必要性和可行性；

(1) The necessity and feasibility for establishment of agencies;

（二）机构的类型、名称和职能；

(2) The types, titles, and functions of the agencies;

（三）司级内设机构的名称和职能；

(3) The titles and functions of internal institutions at the departmental level;

（四）与业务相近的国务院行政机构职能的划分；

(4) The division of functions between the administrative agencies of the State Council whose administrative work is closely related;and 

（五）机构的编制。

(5) The staffing of the agencies. 

撤销或者合并前款所列机构的方案，应当包括下列事项：

The following items shall be included in the programmer for dissolution or merger of the agencies listed in the preceding paragraph: 

（一）撤销或者合并的理由；

(1) The reasons for dissolution or merger;

（二）撤销或者合并机构后职能的消失、转移情况；

(2) The status of the disappearance and transference of the functions after dissolution or merger of agencies; and 

（三）撤销或者合并机构后编制的调整和人员的分流。

(3) The adjustment in staffing and diversion of personnel after dissolution or merger of agencies.

第十条设立国务院议事协调机构，应当严格控制；

Article 10 Establishment of the deliberation and coordination agencies of the State Council shall be subject to strict control. 

可以交由现有机构承担职能的或者由现有机构进行协调可以解决问题的，不另设立议事协调机构。

In case the duties may be allocated to a current agency or a current agency may solve issues through coordination, no establishment of the deliberation and coordination agency shall be allowed. 

设立国务院议事协调机构，应当明确规定承担办事职能的具体工作部门；

In respect of the establishment of the deliberation and coordination agencies of the State Council, the specific ministries or commissions responsible for administrative functions shall be clearly stipulated;

为处理一定时期内某项特定工作设立的议事协调机构，还应当明确规定其撤销的条件或者撤销的期限。

with regard to the deliberation and coordination agencies set up for handling certain specified work within a certain period, conditions or time limits for their dissolution shall also be clearly stipulated.

第十一条国务院议事协调机构的设立、撤销或者合并，由国务院机构编制管理机关提出方案，报国务院决定。

Article 11 the agency and staffing administration organ of the State Council shall bring forward the proposal for the establishment, dissolution or merger of a deliberation and coordination agency of the State Council, which be submitted to the State Council for a decision.

第十二条国务院行政机构设立后，需要对职能进行调整的，由国务院机构编制管理机关提出方案，报国务院决定。

Article 12 Where functions need to be adjusted after the establishment of an agency, the agency and staffing administration organ of the State Council shall bring forward the proposal of the programmer thereof which shall be submitted to the State Council for a decision.

第十三条国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构在职能分解的基础上设立司、处两级内设机构；

Article 13 The internal institutions at the two levels of departments and divisions shall, based on functional assignments, be set up in the General Office of the State Council, the constituent ministries and commissions of the State Council, the agencies affiliated with the State Council, the administrative offices of the State Council;

国务院组成部门管理的国家行政机构根据工作需要可以设立司、处两级内设机构，也可以只设立处级内设机构。

internal institutions at the two levels of departments and divisions may, according to needs of word, be set up in the State agencies administered by the constituent ministries or commissions of the State Council, which may set up internal institutions just at the level of divisions.

第十四条国务院行政机构的司级内设机构的增设、撤销或者合并，经国务院机构编制管理机关审核方案，报国务院批准。

Article 14 The agency and staffing administration organ of the State Council shall verify the programmer for establishment, dissolution or merger of additional internal institutions at the departmental level within the administrative agencies of the State Council, which shall then be submitted to the State Council for approval.

国务院行政机构的处级内设机构的设立、撤销或者合并，由国务院行政机构根据国家有关规定决定，按年度报国务院机构编制管理机关备案。

The administrative agency of the State Council shall, according to the provisions stipulated by the State, decide the establishment, dissolution or merger of internal institutions at the divisional level within an administrative agency of the State Council, which shall be submitted to the agency and staffing administration organ of the State Council for the record.

第十五条增设国务院行政机构的司级内设机构的方案，应当包括下列事项：

Article 15 The following items shall be included in the programmer for establishment, dissolution or merger of an additional internal institution at the departmental level within an administrative agency of the State Council: 

（一）增设机构的必要性；

(1) The necessity for the additional establishment of internal institution;

（二）增设机构的名称和职能；

(2) The titles and functions of the additional establishment of internal institution; and 

（三）与业务相近的司级内设机构职能的划分。

(3) The division of functions between the additional internal establishment of institutions at the departmental level whose administrative work is closely related;

撤销或者合并前款所列机构的方案，应当包括下列事项：

The following items shall be included in the programmer for dissolution or merger of the institution listed in the preceding paragraph: 

（一）撤销或者合并机构的理由；

(1) The reasons for dissolution or merger of the institution;

（二）撤销或者合并机构后职能的消失、转移情况；

(2) The status of the disappearance and transference of functions after dissolution or merger of the institution; and (3) 

（三）撤销或者合并机构后编制的调整。

The adjustment in staffing after dissolution or merger of the institution.

第十六条国务院行政机构及其司级内设机构的名称应当规范、明确，并与该机构的类型和职能相称。

Article 16 The titles of the administrative agencies of the State Council and their internal institutions at the departmental level shall be standardized and clear and comply with their types and functions. 

国务院行政机构及其司级内设机构不得擅自变更名称。

The administrative agencies of the State Council and their internal institutions at the departmental level shall not alter their titles without authorization.

第三章编制管理

Chapter 3 Administration of Staffing

第十七条国务院行政机构的编制依据职能配置和职位分类，按照精简的原则确定。

Article 17 The staffing of administrative agencies of the State Council shall, pursuant to the principle of simplification, be determined in the light of functional al[] and position classification and. 

前款所称编制，包括人员的数量定额和领导职数。

The staffing mentioned in the preceding paragraph shall include numerical quotas of staff and the number of leadership positions.

第十八条国务院行政机构的编制在国务院行政机构设立时确定。

Article 18 The staffing of administrative agencies of the State Council shall be determined at the same time of the establishment thereof. 

国务院行政机构的编制方案，应当包括下列事项：

The following items shall be included in the staffing programmer of an administrative agency of the State Council: 

（一）机构人员定额和人员结构比例；

(1) The numerical quotas of staff and staff structure proportions of the agency; and 

（二）机构领导职数和司级内设机构领导职数。

(2) The number of leadership positions in the agency and that of the internal institutions at the departmental level.

第十九条国务院行政机构增加或者减少编制，由国务院机构编制管理机关审核方案，报国务院批准。

Article 19 In case an administrative agency of the State Council increases or decreases its staffing, the agency and staffing administration organ of the State Council shall verify the programmer thereof, which shall be submitted to the State Council for approval.

第二十条国务院议事协调机构不单独确定编制，所需要的编制由承担具体工作的国务院行政机构解决。

Article 20 The staffing of a deliberation and coordination agency of the State Council is not determined separately, and the administrative agency of the State Council undertaking the specific work shall provide the staffing by the.

第二十一条国务院办公厅、国务院组成部门、国务院直属机构和国务院办事机构的领导职数，按照国务院组织法的规定确定。

Article 21 The number of leadership positions in the General Office of the State Council, the constituent ministries and commissions of the State Council, the agencies affiliated with the State Council, and administrative offices of the State Council shall, according to the provisions stipulated in the Organic Law of the State Council, be determined. 

国务院组成部门管理的国家行政机构的领导职数，参照国务院组织法关于国务院直属机构领导职数的规定确定。

The number of leadership positions in the State agencies administered by the constituent ministries or commissions of the State Council shall, in the light of the provisions stipulated in the Organic Law of the State Council on the number of leadership positions of directly subordinate agencies of the State Council, be determined. 

国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构的司级内设机构的领导职数为一正二副；

The number of leadership positions in internal institutions at the departmental level of the General Office of the State Council, the constituent ministries and commissions of the State Council, the agencies affiliated with the State Council, and the administrative offices of the State Council is one director and two deputy directors;

国务院组成部门管理的国家行政机构的司级内设机构的领导职数根据工作需要为一正二副或者一正一副。

the number of leadership positions in internal institutions at the departmental level of the State agencies administered by the constituent ministries or commissions of the State Council is one director and two deputy directors or one director and one deputy director. 

国务院行政机构的处级内设机构的领导职数，按照国家有关规定确定。

The number of leadership positions in internal institutions at the divisional level of administrative agencies of the State Council shall, according to the provisions stipulated by the State, be determined.

第四章监督检查

Chapter 4 Supervision and Inspection 

第二十二条国务院机构编制管理机关应当对国务院行政机构的机构设置和编制执行情况进行监督检查。

Article 22 The establishment and enforcement of staffing of the administrative agencies of the State Council shall be subject to supervision and inspection by the agency and staffing administration organ of the State Council. 

国务院行政机构应当每年向国务院机构编制管理机关提供其机构设置和编制管理情况的报告。

The reports on the establishment of institutions and staffing administration shall be submitted by the administrative agencies of the State Council to the agency and staffing administration organ of the State Council.

第二十三条国务院行政机构违反本条例规定，有下列行为之一的，由国务院机构编制管理机关责令限期纠正；

Article 23 Administrative agencies of the State Council which, in violation of the provisions stipulated in these Regulations, commit any one of the following activities, shall be ordered to make corrections within the specified time limit by the agency and staffing administration organ of the State Council;

逾期不纠正的，由国务院机构编制管理机关建议国务院或者国务院有关部门对负有直接责任的主管人员和其他直接责任人员依法给予行政处分：

in case of failure to make corrections within the time limit, the State Council or the relevant departments of the State Council may impose administrative sanctions on the person in charge bearing direct responsibility and other persons directly responsible, as suggested by the agency and staffing administration organ of the State Council: 

（一）擅自设立司级内设机构的；

(1) Establishing internal institutions at departmental levels without authorization;

（二）擅自扩大职能的；

(2) Extending functions without authorization;

（三）擅自变更机构名称的；

(3) Altering titles of agencies without authorization;

（四）擅自超过核定的编制使用工作人员的；

(4) Using functionaries other than the staffing determined through verification without authorization; and 

（五）有违反机构设置和编制管理法律、行政法规的其他行为的。

(5) Committing other activities in violation of the provisions stipulated in the laws and regulations concerning agency establishment and administration of staffing.

第五章附则

Chapter 5 Supplementary Rules 

第二十四条地方各级人民政府行政机构的设置和编制管理办法另行制定。

Article 24 The measures for administration of agency establishment and staffing of the agencies of the local people’s governments shall be otherwise formulated. 

国务院行政机构不得干预地方各级人民政府的行政机构设置和编制管理工作，不得要求地方各级人民政府设立与其业务对口的行政机构。

The administrative agencies of the State Council shall not interfere with the establishment and staffing administration of the agencies of the local people’s governments at various levels, and shall not require the local people’s governments at various levels to establish agencies corresponding to their administrative work.

第二十五条本条例自发布之日起施行。

Article 25 This law shall take effect as of the date of promulgation.
