国务院关于国家行政机关和企业事业单位社会团体印章管理的规定

The Rules on the Administration of the Seals of the State Administrative Departments, Enterprises and Institutions and the Social Organizations of the State Council

一、国家行政机关和企业事业单位、社会团体的印章为圆形，中央刊国徽或五角星。

Article 1 The seals of the state administrative departments, enterprises and institutions and the social organizations shall be round in shape and printed with a national emblem or five-pointed star in the center.

二、国务院的印章，直径６厘米，中央刊国徽，国徽外刊机关名称，自左而右环行（图一），由国务院自制。

Article 2 The seal of the State Council shall be made by itself with the diameter of 6 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right. (See illustration 1)

三、各省、自治区、直辖市人民政府和国务院办公厅、国务院各部委的印章，直径５厘米，中央刊国徽、国徽外刊机关名称，自左而右环行（图二），由国务院制发。

Article 3 The seals of the people’s government at the province, autonomous region and municipality level, General Office of the State Council and the ministries and commissions of the State Council shall be made and distributed by the State Council with the diameter of 5 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right. (See illustration 2)

四、国务院直属机构、办事机构的印章，正部级单位的直径５厘米，副部级单位的直径４．５厘米，中央刊国徽，国徽外刊机关名称，自左而右环行（图三），由国务院制发。

Article 4 The seals of the institutions directly under the State Council and the working bodies of the State Council shall be made and distributed by the State Council with the diameter of 5 centimeters for the chief units at the ministry level and 4.5 centimeters for the deputy units at the ministry level, a national emblem in the center and the title of the organizations around the national emblem from left to right. (See illustration 3)

五、国务院直属事业单位的印章，正部级单位的直径５厘米，副部级单位的直径４．５厘米，经国家机构编制管理部门认定具有行政职能的单位的印章中央刊国徽，没有行政职能的单位的印章中央刊五角星，国徽或五角星外刊单位名称，自左而右环行（图四），由国务院制发。

Article 5 The seals of the enterprises directly under the State Council shall be made and distributed by the State Council with the diameter of 5 centimeters for the chief units at the ministry level and 4.5 centimeters for the deputy units at the ministry level, a national emblem in the center of the seal for the units having administrative functions determined by the organization in charge of government establishments of the state and a five-pointed star in the center for those having no administrative functions and the title of the organizations around the national emblem or five-pointed star from left to right. (See illustration 4)

六、国务院议事协调机构和临时机构的印章，直径５厘米，中央刊五角星，五角星外刊机关名称，自左而右环行（图五），由国务院制发。

Article 6 The seals of the discussion and negotiation institutions and temporary institutions of the State Council shall be made and distributed by the State Council with the diameter of 5 centimeters, a five-pointed star in the center and the title of the organizations around the five-pointed star from left to right. (See illustration 5)

七、国务院部委管理的国家局的印章，直径４．５厘米，中央刊国徽，国徽外刊机关名称，自左而右环行（图六），由国务院制发。

Article 7 The seal of the national bureaus under the administration of the ministries and commissions of the State Council shall be made and distributed by the State Council with the diameter of 4.5 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right. (See illustration 6)

八、国务院部委的外事司（局）的印章，直径４．２厘米，中央刊国徽，国徽外刊机关名称，自左而右环行（图七），由国务院制发。

Article 8 The seal of the foreign affairs department/bureau under the administration of the ministries and commissions of the State Council shall be made and distributed by the State Council with the diameter of 4.2 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right. (See illustration 7) 

国务院部门的内设机构和所属事业单位，法定名称中“冠“中华人民共和国”或“国家”的单位的印章，直径４．２厘米，中央刊国徽，国徽外刊单位名称，自左而右环行（图八），由国务院制发。

The seals of the internal institutions and the affiliated enterprises of the departments under the State Council and the units with a title beginning with the People’s Republic of China or national shall be made and distributed by the State Council with the diameter of 4.2 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right. (See illustration 8)

九、自治州、市、县级（县、自治县、县级市、旗、自治旗、特区、林区，下同）和市辖区人民政府的印章，直径４．５厘米，中央刊国徽，国徽外刊机关名称，自左而右环行（图九），由省、自治区、直辖市人民政府制发。

Article 9 The seals of the people’s government at the autonomous state, city and county (county, autonomous county, city at the county level, banner, autonomous banner, special economic zone, forest area, the same below) level and the people’s government of the districts of the city shall be made and distributed by the people’s government at the province, autonomous region and municipality level with the diameter of 4.5 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right.(See illustration 9)

十、地区（盟）行政公署的印章，直径４．５厘米，中央刊五角星，五角星外刊机关名称，自左而右环行（图十），由省、自治区人民政府制发。

Article 10 The seal of the administrative office of the prefecture/league shall be made and distributed by the people’s government at the province and autonomous region level with the diameter of 4.5 centimeters, a five-pointed star in the center and the title of the organizations around the five-pointed star from left to right. (See illustration 10)

十一、乡（镇）人民政府的印章，直径４．２厘米，中央刊五角星，五角星外刊机关名称，自左而右环行（图十一），由县级人民政府制发。

Article 11 The seal of the people’s government at the township/town level shall be made and distributed by the people’s government at county level with the diameter of 4.2 centimeters, a five-pointed star in the center and the title of the organizations around the five-pointed star from left to right. (See illustration 11)

十二、驻外国的大使馆、领事馆的印章，直径４．２厘米，中央刊国徽，国徽外刊机关名称，自左而右环行（图十二），由外交部制发。

Article 12 The seals of the embassy and consulate stationed in foreign counties shall be made and distributed by the Ministry of Foreign Affairs of the People’ Republic of China with the diameter of 4.2 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right. (See illustration 12)

十三、国家行政机关内设机构或直属单位的印章，直径不得大于４．５厘米，中央刊五角星，五角星外刊单位名称，自左而右环行或者名称前段自左而右环行、后段自左而右横排（图十三），分别由国务院各部门和地方各级国家行政机关制发。

Article 13 The seals of the internal institutions and the affiliated enterprises of the state administrative departments shall be made and distributed by the departments of the State Council and the state administrative departments at different levels respectively with a diameter of 4.5 centimeters, a five-pointed star in the center and the title of the organizations around the five-pointed star from left to right or the forepart of the title of the organizations around the five-pointed star from left to right and the rest part horizontally printed from left to right. (See illustration 13)

十四、企业事业单位、社会团体的印章，直径不得大于４．５厘米，中央刊五角星，五角星外刊单位名称，自左而右环行（图十四）。

Article 14 The seals of the enterprises and institutions and the social organizations shall have a diameter less than 4.5 centimeters, a five-pointed star in the center and the title of the organizations around the five-pointed star from left to right. (See illustration 14) 

制发办法由公安部会同有关部门另行制定。

The making and distributing measures shall be provided by the Ministry of Public Security of the People’ Republic of China jointly with other organizations.

十五、国家行政机关和企业事业单位、社会团体印章所刊名称，应为法定名称。

Article 15 The title of the state administrative departments, enterprises and institutions and the social organizations printed on the seals shall be the legal title. 

如名称字数过多不易刻制，可以采用规范化简称。

If the title is too long to be printed on the seal, the standardized abbreviation is applicable. 

地区（盟）行政公署的印章，冠省（自治区）的名称。

The title on the seal of the administrative office of prefecture/league shall begin with the title of the province/autonomous region. 

自治州、市、县级人民政府的印章，不冠省（自治区、直辖市）的名称。

The title on the seals of the people’s government at the autonomous state, city and county level shall not begin with the title of the province (or autonomous region, municipality). 

市辖区人民政府的印章冠市的名称，乡（镇）人民政府的印章，冠县级行政区域的名称。

The title on the seal of the people’s government of the district of the city shall begin with the title of the city and the title of the seals of the people’s government at the township/town level shall begin with the title of the administrative division at the county level.

十六、实行民族区域自治的地方人民政府的印章，可以并刊汉字和相应的民族文字。

Article 16 The seals of the regional people’s government at the regions under regional national autonomy shall be concurrently printed with Chinese characters and the corresponding national characters.

十七、印章所刊汉字，应当使用国务院公布的简化字，字体为宋体。

Article 17 The characters printed on the seals shall be the simplified characters promulgated by the State Council with the font of Song typeface.

十八、印章的质料，由制发机关根据实际需要确定。

Article 18 The material of the seals shall be specified by the making and distributing units according to the actual needs.

十九、各省、自治区、直辖市人民政府和国务院各部委、各直属机构印制文件时使用的套印印章、印模，其规格、式样与正式印章等同，由国务院制发。

Article 19 The overprint seals, molds used in the print of the documents of the people’s government at the province, autonomous region and municipality level, the ministries and commissions of the State Council and the institutions directly under the State Council shall be made and distributed by the State Council with their specifications and patterns the same as those of the formal seals.

二十、国务院有关部委外事用的火漆印，直径４．２厘米，中央刊国徽，国徽外刊机关名称，自左而右环行，由国务院制发。

Article 20 The wax seals used for foreign affairs by the relevant ministries and commissions under the State Council shall be made and distributed by the State Council with the diameter of 4.2 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right.

二十一、国务院的钢印，直径４．２厘米，中央刊国徽，国徽外刊机关名称，自左而右环行，由国务院自制。

Article 21 The steel seal of the State Council shall be made by itself with the diameter of 4.2 centimeters, a national emblem in the center and the title of the organizations around the national emblem from left to right. 

地方外事机构、驻外使领馆钢印的规格、式样，由外交部制定。

The specification and patterns of the steel seals used by the regional institutions of foreign affairs and the embassy and consulate stationed abroad, shall be provided by the Ministry of Foreign Affairs of the People’s Republic of China.

其他确需使用钢印的单位，其钢印直径不得大于４．２厘米，不得小于３．５厘米，中央刊五角星，五角星外刊单位名称，自左而右环行，报经其印章制发机关批准后刻制。

The steel seals of the other units that actually need the steel seals shall have the diameter less than 4.2 centimeters, but more than 3.5 centimeters with a five-pointed star in the center and the title of the organizations around the five-pointed star from left to right and be submit to the making and distributing organizations for approval of print.

二十二、国家行政机关和企业事业单位、社会团体的其他专用印章（包括经济合同章、财务专用章等），在名称、式样上应与单位正式印章有所区别，经本单位领导批准后可以刻制。

Article 22 The other special seals of the state administrative departments, enterprises and institutions and the social organizations (including the seals for business contract, special seal for finance, etc) shall be different with the formal seals in their titles and patterns and be submitted to the leaders of the current units for approval of making.

二十三、印章制发机关应规范和加强印章制发的管理，严格办理程序和审批手续。

Article 23 The making and distributing organizations of the seals shall normalize and strengthen the administration of the making and distributing of seals and rigorously enforce the transaction procedures and the examination formalities. 

国家行政机关和企业事业单位、社会团体刻制印章，应到当地公安机关指定的刻章单位刻制。

The state administrative departments, enterprises and institutions and the social organizations shall have their seals made by the seal-engraving units designated by the local public security organs.

二十四、国家行政机关和企业事业单位、社会团体的印章，如因单位撤销、名称改变或换用新印章而停止使用时，应及时送交印章制发机关封存或销毁，或者按公安部会同有关部门另行制定的规定处理。

Article 24 The seals of the state administrative departments, enterprises and institutions and the social organizations, which will not be used again for the cancel of the organizations, the change of the title or the use of the new seals, shall be handed over to the seals making and distributing organizations for sealing up for keeping or destroy in time, or be disposed according to the other rules provided by the Ministry of Public Security of the People’s Republic of China jointly with other organizations concerned.

二十五、国家行政机关和企业事业单位、社会团体必须建立健全印章管理制度，加强用印管理，严格审批手续。

Article 25 The state administrative departments, enterprises and institutions and the social organizations shall establish and improve the administration system of the seals, strengthen the administration of the use of seals and rigorously enforce the examination formalities. 

未经本单位领导批准，不得擅自使用单位印章。

The seal shall not be used presumptuously without the approval of the leader of the current organization.

二十六、对伪造印章或使用伪造印章者，要依照国家有关法规查处。

Article 26 The personnel counterfeit the seals or use the counterfeited seals shall be investigated in accordance with the relevant regulations of the state.

如发现伪造印章或使用伪造印章者，应及时向公安机关或印章所刊名称单位举报。

The people discover the personnel counterfeit the seals or use the counterfeited seals shall report to the public security organs or the organization as the title refers to on the seal in time. 

具体的印章社会治安管理办法，由公安部会同有关部门制定。

The specific administrative measures on the social public security of the seals shall be provided by the Ministry of Public Security of the People’s Republic of China jointly with other organizations concerned.

二十七、过去有关印章管理的规定，如有与本规定不一致的，以本规定为准。

Article 27 If any previous provisions on the administration of the seals conflict with these Rules, these Rules shall prevail.
