Interim Measures for Automatic Export Licensing for Textile Products

《纺织品出口自动许可暂行办法》已经2005年1月30日商务部第2次部务会议审议通过，现予公布，自2005年3月1日起施行。 部长：薄熙来 二○○五年二月六日

The Interim Measures for Automatic Export Licensing for Textile Products, which was adopted at the second executive meeting of the Ministry of Commerce on January 30, 2005, is hereby promulgated and shall come into force as of March 1, 2005. Bo Xilai, Minister2005-2-6

第一条为加强对纺织品出口的统计分析和监测，及时向出口经营者发布纺织品出口预警信息，根据《中华人民共和国对外贸易法》，制定本办法。

Article 1. The Measures has been formulated in accordance with the Foreign Trade Law of the People's Republic of China for the purpose of strengthening the statistical analysis, and monitoring of the textile export and releasing early?warning information on the textile export promptly to the export dealers.

第二条商务部是纺织品出口自动许可的管理机关，会同海关总署负责制定、调整《纺织品出口自动许可目录》，并在实施前30天，特殊情况下不迟于实施前21天以商务部公告等形式对外公布。

Article 2. The Ministry of Commerce shall be the authority or the administration of automatic export licensing for textile products, and be responsible for formulating and adjusting the Catalogue of Textile Products Subject to Automatic Export Licensing together with the General Administration of Customs, and promulgate it in the form of announcement of the Ministry of Commerce 30 days prior to its implementation, or no later than 21 days prior to its implementation under special circumstances.

对列入《纺织品出口自动许可目录》的纺织品通过《纺织品出口自动许可证》实施出口自动许可管理。

The textile products as listed in the Catalogue for Textile Products Subject to Automatic Export Licensing shall be subject to the automatic export licensing administration through an Automatic Export License for Textile Products.

第三条商务部授权配额许可证事务局统一管理、指导全国各发证机构（发证机构名单见附件1）的《纺织品出口自动许可证》发证工作，配额许可证事务局对商务部负责。

Article 3. The Ministry of Commerce shall authorise the Quota Licensing Bureau to be in uniform charge and guidance of the license issuing work of the license issuing agencies (see Attachment I for the name list of license issuing agencies) throughout the country. The Quota Licensing Bureau shall be accountable to the Ministry of Commerce.

配额许可证事务局及各地方商务主管部门为《纺织品出口自动许可证》的发证机构，在配额许可证事务局统一管理下，负责授权范围内的发证工作。

The Quota Licensing Bureau and all local commercial administrative departments shall be the license issuing agencies of Automatic Export Licenses for Textile Products, and shall, under the uniform administration of the Quota Licensing Bureau, be responsible for the license issuing work within their respective authorised scopes.

第四条《纺织品出口自动许可证》（证书样本见附件2）和出口自动许可证专用章（样章见附件3）由商务部负责统一监制并发放至发证机构。

Article 4. Automatic Export Licenses for Textile Products (see Attachment II for the sample certificate) and the special seal for automatic export licenses (see Attachment III for the sample seal) shall be made under the uniform supervision of the Ministry of Commerce and issued to the license issuing agencies by the Ministry of Commerce.

各发证机构必须指定专人保管，专管专用。

 All license issuing bodies shall designate a special person to keep the seal, which shall be used only for the special purpose.

第五条列入《纺织品出口自动许可目录》的商品，出口经营者在办理海关出口报关手续前，须向发证机构提出自动许可申请并提供以下书面材料：

Article 5. Before an export dealer handles export declaration formalities at the customs for any commodity listed in the Catalogue of Textile Products Subject to Automatic Export Licensing, it shall make an automatic licensing application to the license issuing agency and submit the following written materials:

（一）纺织品出口自动许可证申请表（样表见附件4，出口经营者可到发证机构领取或从商务部网站下载打印）；

(1) An application form for automatic export license for textile products (which can be obtained by exporters from the license issuing agency or downloaded from the website of the Ministry of Commerce for printing);

（二）货物出口合同。

(2) A goods export contract.

首次申请《纺织品出口自动许可证》的出口经营者，除上述材料外，还应向各发证机构提供以下材料的复印件：

Except for the said materials, an export dealer who applies for an Automatic Export License for Textile Products for the first time shall provide photocopies of the following materials to all license issuing agencies:

（一）营业执照；

1. Business license;

（二）进出口企业资格证书或对外贸易经营者备案登记表或外商投资企业批准证书；

2. Credentials for an import and export enterprise or the registration form for foreign trade dealers or an approval certificate for foreign?invested enterprises;

（三）企业年检或外商投资企业联合年检合格证明材料（新设企业可不提交）。

3. The qualified certification materials on the annual examination of the enterprise or joint annual examination of the foreign?invested enterprise (with the exception of newly established enterprises);

上述材料在备案后如发生变化，出口经营者须及时向各发证机构再次提供。

The export dealer shall provide the said materials again to all license issuing agencies in good time in cases where there is any change thereof after the archival filing.

出口经营者应当对所提交材料的真实性负责，并保证其有关经营活动符合国家法律规定。

The export dealer shall be responsible for the authenticity of the submitted materials, and ensure that their business activities are in line with the state laws and regulations.

如果发证机构发现上述材料有错误的，可以责令出口经营者作出修改。

A license issuing agency may order the export dealer to make amendments if any mistake is found in the said materials.

第六条出口经营者可通过网上申请《纺织品出口自动许可证》。

Article 6. An export dealer may apply for an Automatic Export License for Textile Products on the Internet.

网上申请时，出口经营者可登录指定网站，进入相关申领系统，并按要求在线填写纺织品出口自动许可证申请表（电子表格）。

In the case of filing applications online, an export dealer may log on to a designated website, enter into a relevant application system and fill in online an application form of automatic export licenses for textile products (spreadsheet) according to the requirements.

凡通过网上申请的，出口经营者在领取证书时，须向发证机构提供第五条规定的书面材料。

Any export dealer who files an application for a license on the Internet shall provide the license issuing agency with written materials as stipulated in Article 5.

第七条各发证机构收到内容正确且形式完备的自动许可申请后，应当予以签发《纺织品出口自动许可证》，最多不超过10个工作日。

Article 7. Each license issuing agency shall issue an Automatic Export License for Textile Products within 10 working days from receipt of a correct and complete application for automatic licensing.

第八条海关在办理相关纺织品出口手续时，须验核加盖出口自动许可证专用章的《纺织品出口自动许可证》。

Article 8. The customs shall examine the Automatic Export License for Textile Products affixed with a special seal for automatic export licenses while handling formalities relating to the export of textile products.

第九条商务部将定期在政府网站上公布《纺织品出口自动许可目录》所涉商品的信息。

Article 9. The Ministry of Commerce will regularly publish on the government website the information about the commodities involved in the Catalogue of Textile Products Subject to the Automatic Export Licensing.

第十条《纺织品出口自动许可证》实行"一批一证""一证一关"，在公历年度内有效，有效期3个月，逾期作废。

Article 10. The practice of "one license for one batch" and "one license for one customs clearance" shall be implemented relating to Automatic Export Licenses for Textile Products, which shall be effective within a Gregorian calendar year for a period of three months and become invalid upon expiration.

《纺织品出口自动许可证》不得买卖、转让、涂改、伪造和变卖。

No one may traffic in, transfer, alter, forge or sell off any Automatic Export License for Textile Products.

第十一条《纺织品出口自动许可证》如有遗失，出口经营者应立即向原发证机构和《纺织品出口自动许可证》证面注明的报关口岸海关书面报告挂失.

Article 11. In cases where the Automatic Export License for Textile Products is lost, the export dealer shall report the loss immediately to the original license issuing agency and the customs of the clearance port as indicated in the Automatic Export License for Textile Products.

原发证机构收到挂失报告后，经核实无不良后果的，予以重新补发。

The original license issuing agency shall reissue a license upon verification of no harmful consequences after receiving the loss report.

第十二条未申领《纺织品出口自动许可证》，擅自出口纺织品出口自动许可管理货物的，由海关依照有关法律、行政法规的规定处理。

Article 12. Whoever illegally exports any textile product subject to the management of automatic export licensing without applying for an Automatic Export License for Textile Products shall be punished by the customs in accordance with the provisions of the relevant laws and administrative regulations.

第十三条伪造、变造、买卖《纺织品出口自动许可证》或者以欺骗等不正当手段获取《纺织品出口自动许可证》的，依照有关法律、行政法规的规定处理。

Article 13. In the case of forgery, alteration or trafficking of any Automatic Export Licenses for Textiles or obtaining one by unfair means the recipient shall be punished in accordance with the provisions of the relevant laws and administrative regulations.

第十四条纺织品出口自动许可适用于所有贸易方式下对全球或者重点国家、地区的出口。具体监管方式见附件5。

Article 14. The system of automatic export licensing for textile products shall be applicable to the export worldwide or countries or regions under any terms of trade. The specific method of supervision shall be found in Attachment V.

第十五条对从境内区外进入保税区、出口加工区等海关特殊监管区域的列入《纺织品出口自动许可目录》的纺织品，按《保税区海关监管办法》（国函〔1997〕48号）和《中华人民共和国海关对出口加工区监管的暂行办法》（国务院令第389号）的规定办理。

Article 15. Textile products as listed in the Catalogue of Textile Products Subject to Automatic Export Licensing that enter a bonded area, export processing zone or any other special area under the special supervision of the customs from the territory of China or the outside of the said areas shall be handled in accordance with the provisions in the Measures on the Customs Supervision over Bonded Areas (Letter No.48 [1997] of the State Council) and the Interim Measures of the General Administration of Customs of the People's Republic of China for the Supervision over Export Processing Zones (Order No.389 of the State Council).

第十六条本办法由商务部负责解释。

Article 16. The power to interpret these Measures shall be vested in the Ministry of Commerce.

第十七条本办法自2005年3月1日起施行。

Article 17. These Measures shall come into force as of March 1, 2005.
